Nero Limo – Terms and Conditions

These Terms and Conditions (“Agreement”) govern the use of www.nerolimo.com
(“Site”) and the services provided by 16310192 Canada Inc., operating as Nero Limo (“Company,” “we,” “us,” “our”). By accessing our Site or using our services, you (“Client,” “you,” “your”) agree to this Agreement. If you do not agree, please do not use our Site or services.

1. Services Provided

Nero Limo offers ground transportation and chauffeur services, including but not limited to: limousine trip bookings, corporate transportation, special event transportation, and shuttle services. Services may be fulfilled by Nero Limo or affiliated independent owner-operators (see §8B).

2. Reservations and Payments

Booking. All reservations are subject to availability and must be confirmed with a valid credit card.
Payment Timing. We may pre-authorize or charge the card on file 24–72 hours prior to pickup. Bookings made <24 hours before pickup may be charged immediately.
Payment Processing. Online payments are securely processed via Stripe (PCI-compliant) through BookRidesOnline (our booking/dispatch system). Nero Limo does not store full card details.
Payment Methods. Major credit/debit cards. All charges are in CAD unless otherwise stated.
Taxes/Fees. HST and applicable taxes are additional unless expressly included in a quoted flat rate.
Rate Changes. Published rates are subject to change without notice; confirmed at time of reservation.
Gratuity. Tips are voluntary unless a mandatory service charge is disclosed in the quote/confirmation (e.g., large events).

2A. Payment Authorization & Chargeback Policy

By providing payment details, you authorize charges for base fare and any additional fees (waiting time, extra stops, parking/tolls, cleaning, damages, surcharges). Unfounded chargebacks or disputes outside the refund window will be contested using confirmations, GPS logs, and communications. Accounts with unresolved chargebacks may be suspended.

3. Cancellation & Refund Policy

= 8 hours before pickup: 100% refund.
4–8 hours before pickup: 50% charge of total fare.
< 4 hours before pickup: 80% charge of total fare.
No-Show: 100% charge (no refund).
Company Cancellations: If we cancel for operational reasons, 100% refund to original payment method.
Refund Processing Time: Approved refunds are typically processed within 5–10 business days (bank timelines may vary).

4. Additional Charges

Waiting Time.
* Airport drop-off / point-to-point / hourly: 15 min complimentary at pickup.
* Airport pickup: 1 hour (domestic), 1.5 hours (international) complimentary from gate arrival; thereafter CAD 1/min (first 30 min), then CAD 1.50/min.
Tolls & Parking. Billed at cost.
Extra Stops & Route Changes. Unscheduled stops or material route deviations may incur additional time/distance charges.
After-Hours Surcharge (if disclosed). Trips starting 11:00 PM–5:00 AM may carry a surcharge (stated on your quote).
Event/Holiday Surcharges (if disclosed). Peak days (e.g., New Year’s Eve, TIFF/major events, statutory holidays) may include a surcharge shown on your quote/confirmation.

4A. Vehicle Cleaning/Maintenance Fees

Minimum CAD 250 for spills/stains requiring professional cleaning; biohazard (e.g., vomiting) fee CAD 300–500 depending on severity/downtime.

5. Vehicle Availability

We’ll make reasonable efforts to provide your requested model; a similar class may be substituted if necessary. Vehicle images are illustrative.

6. Booking Amendments

Changes = 8 hours before pickup: no admin fee (fare may adjust to the new itinerary).
Changes < 8 hours: subject to availability and additional charges at Nero Limo’s discretion.

7. Conduct & Use of Services

Seatbelts must be worn where required by law. The following are prohibited:
* Smoking/vaping in vehicles (violation may incur cleaning fees)
* Illegal substances or open alcohol where prohibited by law
* Unsafe, abusive, or threatening behavior (service may be terminated without refund)
We reserve the right to refuse service for safety/non-compliance.

8. Limitation of Liability

We are not liable for indirect, incidental, special, or consequential damages, including due to traffic, weather, construction, collisions, mechanical issues, road closures, or unforeseeable events; loss/damage to personal items; or actions of third parties. We maintain commercial liability insurance; claims beyond coverage are not our responsibility.

8A. Service Timing Disclaimer

We strive for punctuality but exact pickup/drop-off times cannot be guaranteed due to conditions outside our control (weather, roads, airport operations). We are not responsible for missed flights or events in such circumstances.

8B. Independent Owner-Operators & Liability

Services may be fulfilled by independent owner-operators and licensed affiliates (“Chauffeur Partners”), each responsible for commercial insurance, licensing, and compliance. Nero Limo does not own or directly operate all vehicles and is not liable for loss, injury, delay, accident, or damage arising from acts/omissions of these independent parties beyond our coordination role. In an incident, claims may be directed to the applicable operator’s insurer; we will reasonably assist with documentation.

9. Luggage, Capacity & Safety

Capacity. Do not exceed the passenger or luggage capacity quoted. Oversized/extra luggage may require a larger vehicle (additional charges).
Prohibited Items. No hazardous materials, weapons, or items restricted by law.
Lost & Found. Items left in vehicles are held when found; no liability is assumed. Unclaimed items may be disposed of after 30 days.

10. Children, Car Seats & Unaccompanied Minors

Child Safety. Ontario child restraint laws apply. Upon request and subject to availability, we can provide child/booster seats (additional fee per seat). You are responsible for correct installation unless you purchase our driver-assisted installation (where permitted).
Unaccompanied Minors. Transport of minors without a guardian requires prior written consent and may be refused.

11. Pets & Service Animals; Accessibility

Service animals are welcome at no charge. Pets may travel in a carrier and must be declared when booking; a cleaning fee may apply for shedding/accidents.
If you require wheelchair-accessible arrangements or specific assistance, inform us at booking so we can coordinate suitable equipment/vehicles where available.

12. Flight Monitoring & Pickup Protocols

We may track flights using publicly available data to adjust dispatch within reasonable limits. You must provide correct flight details and notify us of changes. Meet-and-Greet (if requested) may carry a fee and includes specified wait time; additional waiting billed per §4.

13. Privacy & Data Collection

We collect personal information (e.g., name, phone, email, itinerary) to provide and improve services. We do not sell personal data. Reasonable technical/organizational measures are used to protect information.

13A. Data Protection Compliance

We comply with PIPEDA. Personal information is used only for service delivery/legitimate purposes and disclosed as required by law or with consent.

13B. Communications Consent (Email/SMS)

By booking, you consent to transactional communications (emails/SMS) about your trip (confirmations, driver status, receipts). Standard carrier rates may apply. Marketing messages are sent only with consent; you can unsubscribe at any time.

13C. Cookies & Analytics

Our Site may use cookies/analytics to improve functionality and measure performance. You can adjust browser settings to refuse cookies; some features may not function properly.

14. Force Majeure

We are not liable for failure or delay due to events beyond reasonable control, including but not limited to natural disasters, public emergencies, pandemics, labor disputes, government actions, or major infrastructure outages.

15. Third-Party Platforms

Reservations processed through third-party systems (e.g., BookRidesOnline, concierge partners, affiliate sites) are also subject to their terms/privacy. We are not responsible for technical issues or delays caused by those platforms.

16. Cross-Border Travel & Identification

For trips crossing international borders, valid travel documents are your responsibility. We are not liable for denial of entry, customs delays, or related costs. Additional time/fees may apply for border procedures.

17. Estimates, Typos & Errors

We strive for accuracy but typographical or system errors may occur. If a material pricing/availability error is identified, we may void or reissue the quote/booking with the correct information.

18. Governing Law

This Agreement is governed by the laws of the Province of Ontario, Canada.

19. Dispute Resolution

Disputes shall be resolved by binding arbitration in Ontario, Canada. Parties share arbitration costs equally. Small claims court recourse is excluded.

20. Severability

If any provision is invalid or unenforceable, the remaining provisions remain in full force and effect.

21. Amendments

We may amend these Terms at any time. Material changes will be notified by email or posted on the Site. Continued use constitutes acceptance.

22. Digital Acceptance

Booking via our Site, email, or phone constitutes an electronic signature and acceptance of these Terms under applicable electronic transaction laws.
